Belleville apartment tenant sues over alleged toxic mold exposure

BELLEVILLE – The tenant of a Belleville apartment alleges he was exposed to toxic mold after the property flooded.

Corey Beard filed a complaint on Dec. 28 in the St. Clair County Circuit Court against The Estates Property Management, First National Bank of Carlyle and Kent Loepker, alleging negligence.

According to the complaint, the plaintiff leased a property on Vicksburg Drive in Belleville that was maintained by Estates Property Management. The suit states the plaintiff entered into the lease in September 2015 and that in December, the apartment was flooded by water. 

He alleges that on April 20, 2016, he discovered that toxic mold and its spores, fragments, colonies and mycotoxin were festering in the apartment unit. 

As a result, he alleges he sustained injuries both internally and externally and was compelled to expend sums of money for medical care and treatment expenses. 

The plaintiff alleges the defendants failed to remediate the water intrusion to the unit and failed to fix the dangerous condition.

The plaintiff seeks damages of more than $50,000, plus costs of this suit and all further relief that the court may deem just and proper.
