Government seeks to foreclose on Johnson City property

BENTON – The federal government is seeking to foreclose on a Johnson City property over allegations mortgage payments have not been received since 2016.

United States of America filed a complaint for foreclosure on Dec. 19 in the U.S. District Court for the Southern District of Illinois against Austin W. Holmes, deceased; Nicole E. Holmes; Brittany Holmes; Leisa J. Holmes, as administrator of the estate of Austin W. Holmes; and the city of Johnston City.

According to the complaint, the plaintiff alleges that on Oct. 8, 2009, Austin Holmes and Nicole Holmes mortgaged a real property located at 800 W. Ninth Street in Johnston City through plaintiff's agency for $75,000. As of July 7, the total amount allegedly now due is $99,435.25, interest included. 

The plaintiff holds the defendants responsible because the defendants allegedly failed to pay the monthly instalments of principal, interest, taxes, and/or insurance from May 4, 2016, through the present.

The plaintiff seeks an order for foreclosure and sale by public auction of the subject property. It is represented by Donald S. Boyce and Gerald M. Burke of United States Attorney's Office in Fairview Heights.
