Former Providers Plus employee alleges biometric data collected without consent

BELLEVILLE – A Belleville man alleges a Missouri corporation with a location in Fairview Heights unlawfully collected his biometric information.

Ted Harry filed a complaint individually and on behalf of all others similarly situated on Nov. 29 in the St. Clair County Circuit Court against Providers Plus Inc., alleging the employer violated the Illinois Biometric Information Privacy Act (BIPA).

According to the complaint, the plaintiff was employed by the defendant from 2010 to 2013 and was required to clock in and out of his shifts by scanning his hand with a biometric timeclock. He alleges the defendant captured and collected biometric information of its employees without properly obtaining a written executed release.

The plaintiff requests a trial by jury and seeks an order certifying this case as a class action, appointing plaintiff as class representative, award for all damages, litigation expenses and any further relief that the court may deem appropriate.
