Man blames colon cancer on asbestos exposure from Aurora Pump, others' products

EDWARDSVILLE – A man alleges his colon cancer was caused by exposure to asbestos during his working career.

Reuben Fitzgerald and Delores Fitzgerald filed a complaint on Nov. 9, in the St. Clair County Circuit Court against Aurora Pump Co., Borg-Warner Morse Tec LLC, The Budd Co., et al. alleging negligence.

According to the complaint, the plaintiffs allege that throughout Reuben Fitzgerald's entire career from 1962 to 2010, he was exposed to and inhaled or absorbed large amounts of asbestos fibers emanating from certain products that were manufactured, sold, distributed or installed by defendants. The suit states that on or about April 4, he first became aware that he developed colon cancer, an asbestos-induced disease. 

The plaintiffs hold Aurora Pump Co., Borg-Warner Morse Tec LLC, The Budd Co., et al. responsible because the defendants allegedly intentionally included asbestos fibers in their products when they knew that it has toxic, poisonous and deleterious effect to humans and failed to provide adequate warnings and instructions concerning the dangers of working with or around asbestos-containing products.

The plaintiffs seek judgment be entered against defendants for a sum exceeding $50,000. They are represented by Randy L. Gori of Gori, Julian & Associates PC in Edwardsville.
