EDWARDSVILLE – A driver alleges his injuries were caused by another driver's failure to yield.
Brian Phipps filed a complaint on Oct. 11 in the Madison County Circuit Court against Leobardo Ortiz alleging negligence.
According to the complaint, the plaintiff alleges that on Oct. 17, 2016, he was operating a motor vehicle traveling southbound on Missouri Avenue when the defendant's vehicle collided with his when attempting to make a left turn onto West Pontoon Road. He alleges he sustained permanent injuries, was caused to experience pain and suffering and incurred medical expenses.
The plaintiff holds Ortiz responsible because the defendant allegedly failed to maintain a careful lookout, failed to yield to incoming vehicles and failed to reduce speed.
The plaintiff requests a trial by jury and seeks damages of more than $50,000, plus costs of the action. He is represented by Jane Unsell of Unsell, Schattnik & Phillips PC in Wood River.
