BELLEVILLE – A St. Louis man alleges his bank account was wrongfully garnished after a judgment was filed against his soon-to-be former wife.
Thaddeus Teahan filed a complaint on Sept. 29 in the St. Clair County Circuit Court against PNC Bank NA and Michael Gmanculich, citing the Illinois Consumer Fraud and Deceptive Business Practices Act.
According to the complaint, the plaintiff alleges that as a result of the defendants' conduct, his private PNC Bank account was wrongfully garnished. He adds that Gmanculich filed a lawsuit in 2016 against Teahan's wife, but never named the plaintiff a party in the lawsuit. Then the bank allegedly violated its own policies and procedures by disclosing information of his private account to his wife.
The plaintiff alleges PNC Bank allegedly failed to perform any verification to determine that the plaintiff was a party to the judgment.
The plaintiff seeks damages of more than $50,000 and any further relief as the court may deem just and proper.
