Royal Pines Condominium Association allegedly failed to repair property

Contract 01

BELLEVILLE – A Maryland Heights, Mo., resident alleges her condominium has been damaged because of a settling foundation and the condominium association has failed to make repairs for more than five years.

Denise R. Edwards filed a complaint on Oct. 6 in the St. Clair County Circuit Court against Royal Pines Condominium Association, alleging breach of contract and negligence.

According to the complaint, the plaintiff alleges that between 2011 and 2016, she continued to report worsening cracks in the walls, ceiling, door and window frames and kitchen cabinets to her unit, which was caused by the condominium's foundation settling. To date, her unit allegedly remains badly damaged.

The plaintiff alleges the defendant failed and refused to take responsibility for the damages to her unit and failed to make the required necessary repairs to the interior of her unit.

The plaintiff requests a trial by jury and seeks damages of more than $50,000 and all further relief as the court may deem just and proper.

She is represented by Joseph G. Nassif of Nassif Law Firm in Creve Coeur, Mo., and Bernard J. Ysursa of Cook, Ysursa, Bartholomew, Brauer & Shevlin LTD in Belleville.
