Driver seeks damages, uninsured motorist coverage after East St. Louis collision

EDWARDSVILLE – A man alleges he was injured in a collision in East St. Louis when another driver violated a stop sign.

Tobias Austin filed a complaint on Sept. 11 in the Madison County Circuit Court against Richard E. Spencer Jr. and Geico Casualty Co. alleging negligence against Spencer.

According to the complaint, the plaintiff alleges that on Oct. 30, 2016, he was operating a motor vehicle owned by his mother and insured by Geico when defendant Spencer negligently caused his vehicle to collide with the plaintiff's vehicle. The suit states Austin had lawfully entered the intersection at 72nd Street and Eureka when Spencer violated a stop sign.

As a result of the violent impact, the suit states the vehicle was a total loss and the plaintiff sustained severe injuries to his back, head, abdomen and lower extremities. 

The plaintiff holds Richard E. Spencer Jr. and Geico Casualty Co. responsible because defendant Spencer allegedly failed to yield right of way and illegally entered the intersection and defendant Geico refused to make any payments to plaintiff's injuries and damages for underinsured motorist coverage.

The plaintiff seeks damages of more than $50,000, plus costs of this action and all other relief as the court may deem just and proper. He is represented by Gonzalo Fernandez of Deveraux, Stokes, Fernandez & Leonard PC in St. Louis.
