Highland H&R Block franchisee alleges breach of contract

EDWARDSVILLE — An H&R Block franchisee is suing two people who allegedly failed to make payments after purchasing the Highland business. 

Betty J. Voss filed a complaint on Aug. 29, in the Madison County Circuit Court against Clarence Barney Jr. and Daniel R. Barney, alleging they failed to perform their contractual obligations.

According to the complaint, the plaintiff alleges that in September 2015, the defendants contracted Voss to sell her H&R Block franchise in Highland. However, Voss claims the defendants breached their contract, causing her to suffer damages for the unpaid instalments, rents, commissions and utilities, in a total amount in excess of $165,000. 

The plaintiff alleges the defendants failed to make all the payments listed in the contract.

The plaintiff requests a trial by jury and seeks judgment against the defendants in an amount in excess of $165,000, pre and post-judgment interest, and such other just and proper relief.
