BELLEVILLE – A widow alleges her late husband's death was caused by lung cancer related to asbestos exposure.
Penelope Bidwell, individually and as special representative of the estate of Robert Bidwell Jr., filed a complaint on Aug. 10 in the St. Clair County Circuit Court against Borg-Warner Morse Tec LLC, The Budd Co., Cardinal Industrial Insulation Co. Inc., et al. alleging negligence.
According to the complaint, the plaintiff alleges that at various times during Robert Bidwell Jr.'s employment from 1969 to 2005, he was exposed to and inhaled asbestos fibers emanating from certain products manufactured, sold, distributed and/or installed by defendants. The suit states he first became aware that he had developed lung cancer on Jan. 4, and died in May 10.
The plaintiff holds Borg-Warner Morse Tec LLC, The Budd Co., Cardinal Industrial Insulation Co. Inc., et al. responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.
The plaintiff seeks economic damages of more than $50,000. She is represented by Randy L. Gori and Barry Julian of Gori, Julian & Associates PC in Edwardsville.
