Alcoa Inc., CBS Corp., others named in representative's alleged asbestos death suit

BELLEVILLE – An Arizona man alleges his decedent died of lung cancer caused by asbestos exposure.

Jason Utt, individually and as special representative of the estate of Michael Utt, deceased filed a complaint on July 19 in the St. Clair County Circuit Court against Alcoa Inc., Allied Insulation Supply Co. Inc., Borg-Warner Corp., Caterpillar Inc., CBS Corp., et al. alleging negligence and other counts.

According to the complaint, the plaintiff alleges that during his decedent Michael Utt's employment from 1968 to 2013 at various locations in Ohio, he was exposed and inhaled asbestos fibers from certain products manufactured, sold, distributed or installed by defendants. As a result, Michael Utt was caused to develop lung cancer and died on May 18, 2017, the suit states. 

The plaintiff holds the defendants responsible because the defendants allegedly negligently included asbestos fibers in their products when adequate substitutes were available and failed to provide adequate warnings and instructions concerning the dangers of working with or around products containing asbestos fibers.

The plaintiff seeks judgment against defendants of more than $50,000, punitive damages and all other relief that the court may deem appropriate. He is represented by Ethan A. Flint and Laci M. Whitley of Flint Law Firm LLC in Edwardsville.
