Woman alleges injuries from train collision

EDWARDSVILLE — A woman alleges she was injured when a car she was riding in was struck by a train.

Taran Brobst filed a complaint on June 27 in Madison County Circuit Court against The Kansas City Southern Railway Company, CSX Transportation Inc., Timothy R. Parker and Richard E. Ninness, alleging they failed to use ordinary and reasonable care while managing and operating a train.

According to the complaint, the plaintiff alleges that on June 29, 2015, she was a passenger in a vehicle driven by Greg Lawson, traveling east on County Road 460 East in Hillview. 

Brobst claims that while the driver attempted to cross railroad tracks, which are frequently used by community residents to cross, the vehicle was struck by the defendants' train. 

As a result, Brobst claims she suffered severe physical injuries, mental anguish and medical bills. 

The plaintiff alleges the defendants failed to provide adequate crossing protection devices, failed to provide a yield sign for motorists approaching, failed to warn vehicles the train was approaching and failed to decrease speed so as to avoid collision.

The plaintiff requests a trial by jury and seeks judgment for an equitable sum in excess of $50,000, plus costs of action and any other relief the court deems just and proper.
