Buyers allege sellers failed to make repairs required by contract

EDWARDSVILLE — Two home buyers are suing the sellers for allegedly failing to make repairs to the home they sold.

Robert N. Husted and Beverly J. Husted filed a complaint on March 29 in the Madison County Circuit Court against Joseph and Janice Buchwald, alleging they failed to meet their repair obligations under their contract.

According to the complaint, the plaintiffs allege the defendants assured them that damages on a property they purchased had been repaired following an inspection. However, the Husteds claim they discovered that many of the 24 items listed on the contract were not repaired by a qualified licensed contractor. 

The plaintiffs allege the defendants failed to repair all the items listed on the inspection report prepared by the licensed real estate inspector Metro East Home Inspection LLC.

The plaintiffs request a trial by jury and seek judgment against the defendants in excess of $50,000, plus attorneys' fees and costs of this suit.
