Customer accuses Viagra manufacturers of product liability

BELLEVILLE — A Florida man is suing Pfizer, alleging fraudulent misrepresentation and concealment.

Ernest Mike Cross filed a lawsuit July 21 in St. Clair County Circuit Court against Pfizer Inc., alleging unjust enrichment and breach of duty in failing to exercise due care.

According to the complaint, prior to July 2012, Cross' physician had prescribed and/or dispensed Viagra to him, which the plaintiff took as needed. In July 2012, the suit says, Cross was diagnosed with malignant melanoma, causing him to suffer personal injuries and damages. 

The plaintiff alleges Pfizer designed, manufactured, tested, marketed, advertised, promoted and sold the unsafe drug, Viagra, negligently concealed and/or misrepresented the risks, dangers, defects and disadvantages of taking Viagra and failed to educate health care providers about the safest use of Viagra.

Cross seeks a trial by jury, compensatory damages, punitive damages, interest, costs of suit, attorney fees and all relief the court deems proper. He is represented by attorneys John J. Driscoll and Gregory J. Pals of The Driscoll Firm PC in St. Louis.
