EDWARDSVILLE – A woman is suing over injuries she allegedly received in the course of a rear-end collision. She is citing negligence.
Sarah E. Whitsell filed the suit April 25 in Madison County Circuit Court against Benjamin E. Davis and RGTJ Enterprises LLC.
On Sept. 9, 2015, the plaintiff was driving in a southbound direction on Nameoki Road in Chouteau Township, and the defendant Davis was driving behind the plaintiff's vehicle, the suit says. The plaintiff had to yield to traffic in front of her vehicle, at which time the defendant allegedly drove into the rear of her car, the suit claims.
The suit alleges negligence on the part of Davis, including failing to keep his vehicle under proper control, failing to keep a proper lookout, failing to yield to traffic in front of him, and failing to exercise ordinary care and caution in operating his vehicle. At the time, he was driving a vehicle owned by defendant RGTJ Enterprises.
As a result of the collision, the plaintiff was injured in her neck and back, will continue to suffer pain, will continue to lose wages, she has spent money on medical care, and she has lost her normal enjoyment of life, the suit alleges.
The plaintiff seeks a judgment in excess of $50,000 from both defendants. She is represented by John T. Papa of Callis, Papa & Szewczyk PC in Granite City.
