EDWARDSVILLE – A motorist is suing over injuries he allegedly received when his car was struck by another and pushed along a roadway. He is citing negligence, and is suing the estate of the person alleged to be the other driver, who is now deceased.
William H. Weisberg filed the suit Jan. 4 in Madison County Circuit Court against the estate of Christina M. Martinez.
On March 9, 2014, the plaintiff was driving his motor vehicle eastbound on McAdams Parkway in Madison County, the suit says. The defendant was driving her vehicle eastbound along the same roadway behind the plaintiff when she allegedly collided with the rear of his vehicle, pushing it approximately 100 feet east of its intersection with Clifton Terrace Road, according to the suit.
The defendant's alleged negligence included speeding, failing to keep a lookout, failing to sound a warning of her approach, and driving while under the influence of drugs and alcohol, the suit claims.
The plaintiff claims he was injured in his neck, head, back, shoulders, knees and wrists. He has incurred medical expenses and expects additional expenses in the future, the suit alleges, adding that he has lost mobility and the pleasures of life.
The plaintiff seeks a judgment greater than $50,000 against the deceased defendant's estate plus court costs and other relief the court deems proper. He is represented by Julia M. Kerr of Brown & Crouppen PC in St. Louis.
