Woman alleges mistreatment by officer during visitation with children

EDWARDSVILLE – A mother who says she was visiting her children is suing over the alleged treatment she received by a police officer.

Rachel Abney filed the suit March 22 in Madison County Circuit Court against parties identified as Officer Jackson, Mayor Miller and the City of Collinsville.

On March 22, 2014, the plaintiff was visiting her children at her mother's home in Collinsville, the suit says. She allegedly had a disagreement with her mother during the visit. The older woman asked the plaintiff to leave, but the plaintiff responded that it was her court-scheduled visitation time and refused to leave.

Abney's mother allegedly called the Collinsville Police and Jackson responded, the suit alleges. The officer allegedly ordered the plaintiff to leave, but she still refused, saying it was her scheduled visitation time with her children.

In response, Abney claims the officer allegedly assaulted her, using excessive force, according to the complaint.

The City of Collinsville and defendant Miller are alleged to have been negligent in that they failed to supervise and properly train Jackson in executing his duties as a police officer.

As a result, the plaintiff claims she was permanently disabled, has lost wages and endured pain and suffering, the suit says.

The plaintiff seeks damages for medical expenses, pain and suffering, lost wages and disability. She is represented by H. Carl Runge Jr. of the Law Offices of H. Carl Runge Jr. in Collinsville.
