Missouri man blames Pinnacle Foods for parking lot fall, injuries

EDWARDSVILLE – A Missouri man is suing a food market chain, alleging negligence over injuries he says he suffered when he slipped and fell on an ice-covered parking lot.

Harold Keebler filed the lawsuit Feb. 16 in Madison County Circuit Court against Pinnacle Foods Inc., Pinnacle Foods Group LLC, Pinnacle Foods Corporation, Effingham Crossroads Center LLC, FedEx Corporation and Genco, a FedEx company, alleging negligence.

According to the complaint, on Feb. 17, 2014, Keebler was on the Pinnacle Foods' premises at 2701 S. Banker St. in Effingham during business hours when he allegedly slipped and fell on ice in the parking lot.

As a result of the fall, Keebler claims he suffered severe injuries, including his right wrist, which has required medical, surgical and rehabilitative treatment.  

The suit says the defendants breached their duty to keep the premises reasonably safe by failing to keep the parking lot in a reasonably safe condition, failing to properly maintain the premises, failing to inspect and discover unsafe conditions, failing to warn the plaintiff of the unsafe conditions and negligence in the operation, maintenance, control and upkeep of its premises.

The plaintiff also alleges he has accumulated medical expenses, lost earnings from his employment, suffered a loss of quality of life, experienced pain and suffering and has sustained permanent injury and disability.

Keebler seeks judgment against all the defendants for more than $50,000, plus court costs. He is represented by attorney Shaun M. Lieser of the Lieser Law Firm LLC in St. Louis.
