Woman alleges tractor-trailer's swing door struck her car while waiting in McDonald's drive-thru

A St. Clair County woman is suing three defendants, alleging a tractor-trailer's swing door hit her vehicle and injured her while she waited in line at a McDonald's drive-thru.

Lenora Tolson-Mosby filed the lawsuit on Oct. 28 in St. Clair County Circuit Court against Golden State Foods, Tim Marcum and CLJC Inc., alleging negligence.

According to the complaint, on Oct. 29, 2013, Tim Marcum, an employee of Golden State Foods, parked his tractor-trailer along the side of the McDonald's Restaurant at CLJC's 906 Carlyle Ave. in St. Clair County. The suit says the vehicle was blocking the drive-thru while Marcum was unloading it. Tolson-Mosby was idling her vehicle next to the truck while waiting at the drive-thru.

When Marcum swung open the trailer door, it struck the plaintiff's vehicle with such force, the suit says, she endured injuries to her head and neck, causing nerve damage, headaches, dizziness and sustained contusions and bruising to her body, the suit states.

Tolson-Mosby seeks a trial by jury, as well as a judgment against the three defendants of more than $50,000, plus court costs and attorney fees. She is represented by attorney Richard J. Lecinski of St. Louis.
