Insurance company sues driver to regain money paid to passenger in medical expenses following Hamel accident

An automobile insurance carrier is suing a driver in an attempt to regain $105,000 in medical expenses paid to the passenger, its insured.

State Farm Automobile Insurance Company filed a subrogation lawsuit on Oct. 22 in the Madison County Circuit Court against Trey Kellogg in an attempt to regain money paid to plaintiff's insured, Victoria Mclain.

According to the complaint, on Oct, 21, 2013 the defendant allegedly negligently drove into a ditch near 201 Hamel Drive in Hamel Township injuring his passenger, Victoria McLain. As a result the plaintiff paid $105,000 in medical expenses to its insured. The plaintiff now seeks to recover those funds from the alleged negligent driver.

The plaintiff is demanding $105,000, plus costs of litigation.

The plaintiff is represented by Yodkin & Brebner of Waukegan.
