Transportation company sued for allegedly failing to pay proper overtime compensation

Several employees at a St. Clair County transportation company claim they were not paid time-and-a-half for overtime work performed in the past six years.

John Stell, Charles Williams Jr. and other employees have filed a lawsuit against Gibco Motor Express, LLC on Aug. 28 in the St. Clair County Circuit Court, citing a violation of the Illinois Wage Payment and Collection Act.

According to the complaint, the plaintiffs claim they were not paid wages for hourly work in excess of 40 hours per workweek at a rate of time-and-a-half their regular hourly rate for time worked from June 1, 2009 to the present.

They are seeking unpaid overtime pay, penalties and liquated damages for underpayments.

They are represented by St. Louis attorneys Kevin J. Dolley, Mary Anne Sedey and attorney G. Michael Stewart of Simons Hanly Conroy, LLC.
