An O'Fallon man is suing JJD Properties over claims of deceptive business practices regarding the concealment of bathroom mold.
Benjamin J. Sims Sr. filed a complaint on July 31 in St. Clair County Circuit Court against JJD Properties LLC, alleging consumer fraud and deceptive business practices.
The complaint states that Sims closed on a real estate purchase contract with JJD Properties on July 31, 2014.
The complaint alleges that prior to Sims entering into a contract to purchase real estate with JJD Properties for a property located at 319 Wellsley in O'Fallon, JJD discovered mold when remodeling the property's bathroom, and, according to the contract, was required to provide a mold inspection report stating that the property was free of mold.
According to the complaint, JJD obtained a limited mold inspection and report from Greystone Environmental Inc., and, in an attempt to deceive Sims, placed air fresheners in the property's bathroom.
Sims sustained damages to his property as a result of the alleged deceptive, false, concealed, misrepresented, suppressed, and/or omitted facts regarding the bathroom mold, in violation of the Consumer Fraud and Deceptive Business Practices Act, the suit states.
Sims seeks damages of more than $30,000, plus attorney fees and court costs.
