Route 158 accident blamed on driver who failed to keep proper lookout

A woman claims she sustained disabling injuries after a driver rear-ended her.

Linda S. and Dale A. Hoepfinger filed a lawsuit Sept. 10 in St. Clair County Circuit Court against Austin C. Brouk.

In their complaint, the Hoepfingers allege Linda S. Hoepfinger drove her 2003 Nissan Altima east on State Illinois Highway Route 158 on Nov. 30, 2011, at about 3:21 p.m. when Brouk, who drove his 2000 Ford Explorer in the same direction, struck the back of the Altima.

Because of the accident, Linda Hoepfinger sustained injuries to her low back, suffered great pain and mental anguish and incurred medical costs, according to the complaint. She also lost wages, the suit states.

Dale A. Hoepfinger alleges he lost his wife’s services and has been deprived of her affection, society, companionship and consortium, the complaint says.

The Hoepfingers blame Brouk for causing the collision, saying he negligently failed to keep a proper lookout, failed to keep the vehicle he was operating under proper control, failed to reduce his speed to avoid a collision, failed to keep a proper lookout, failed to stop to avoid a collision and failed to pay attention to the operation of the vehicle.

In their two-count complaint, the Hoepfingers seek a judgment of more than $100,000, plus costs.
