Madison County Circuit Judge William Mudge has scheduled a case management conference for Oct. 30 at 9 a.m. for a lawsuit against Lilypad Learning Center alleging a minor girl fell from a fireman’s pole, causing her to break her arm.
According to the complaint filed May 15, Javon Garrett claims her daughter, A’lon Garrett, was playing at Lilypad Learning Center on Oct. 23, 2012, when she was allowed to use the fireman’s pole. While playing on the pole allegedly unsupervised, Javon Garrett claims her daughter fell and injured herself.
Javon Garrett blames Lilypad for causing her daughter’s injuries, saying it negligently failed to properly train its employees to supervise children, failed to warn of a dangerous condition and failed to properly supervise A’lon Garrett.
The plaintiffs seek a judgment of more than $100,000.
