Madison County Circuit Judge Dennis Ruth ordered trial for a lawsuit against Lowe’s Companies Inc. over allegations of falling lumber.
A jury trial is scheduled for Dec. 1, 2014, at 9 a.m.
According to the complaint filed in February, John S. Clark claims he was shopping at the Lowe’s on Homer Adams Parkway in May 2012 when he tried to move a single six-foot fence panel from a stack of nearly two dozen. Clark alleges the entire stack of lumber fell on top of him, causing him permanent injuries.
Lowe’s replied to the complaint on May 7 claiming Clark is to blame for his injuries due to his own negligence.
Clark responded to Lowe’s answer on May 13, denying the affirmative defenses.
Clark seeks a judgment of $50,000.
