Status conference continued in suit against Wal-Mart involving broken toilet seat

St. Clair County Circuit Judge Vincent Lopinot continued a status conference to Nov. 25 at 9 a.m. in a lawsuit against Wal-Mart over an alleged faulty toilet seat.

According to the complaint filed on March 18, Clifford Greer claims he was shopping at the Wal-Mart in Cahokia in October 2011 when the toilet seat he was sitting on slid out from under him, causing him to fall.

Greer blames Wal-Mart for causing his injuries, saying the store negligently failed to properly install the toilets, the suit states.

Wal-Mart responded to the lawsuit arguing that the plaintiff caused his own injuries when he failed to use the available hand-holds and when he decided to use the toilet seat as a means to stabilize himself when transferring from his wheelchair to the toilet.

Kirk A. Caponi of the Law Offices of Williams, Caponi and Foley in Belleville represents Greer.

James DeFranco and Darrell J. Flesner of DeFrano & Bradley represents Wal-Mart.
