Couple sued over alleged failure to close on $310K real estate deal

A St. Clair County couple is accused of walking away from a $310,000 real estate deal.

Tamadean Goldenhersh filed a lawsuit Aug. 26 in St. Clair County Circuit Court against Ann M. and David A. Miller.

According to the petition, the Millers agreed to buy two Belleville properties from Goldenhersh in April 2010. A month later, Goldenhersh says she signed the contract with the purchase price of $310,000. She says she and the defendants agreed to close on the sale in October 2010.

Goldenhersh claims the Millers failed to pay the purchase price by the due date, so she served them with a legal notice of default later that month. Goldenhersh says she was eventually able to sell the properties to a different buyer in July 2012.

Goldenhersh accuses the defendants of breach of contract and asks to be awarded a judgement of more than $83,000 in damages along with attorney's fees and costs of the lawsuit.
