Case management continued in disabled woman's suit against MCT and Agency for Community Transit

Madison County Circuit Judge Andreas Matoesian continued a case management conference (CMC) in a suit against Madison County Mass Transit (MCT) and the Agency for Community Transit regarding a disabled woman’s alleged injuries.

Matoesian reset the CMC to Oct. 30 at 9 a.m.

The defendants are seeking to dismiss Pamela Jo Byrd’s suit filed in February, which claims Pamela suffered injuries, including subdural hemorrhaging, after falling backwards from her wheelchair while attempting to board the bus in March 2012.

Guardians Laverne F. DeMent and Frances E. Abbett blame an MCT employee for Byrd’s injuries.

MCT and the Agency for Community Transit have denied liability for injuries and filed affirmative defenses, stating that if they are at all liable, the amount of fault attributable to the defendants should be less than 25 percent of the total fault.

The plaintiffs seek a judgment of more than $50,000.
