Driver blamed for failing to yield in Godfrey accident

A woman claims she suffered neck and right shoulder injuries after a driver failed to obey a stop sign and struck her vehicle.

Lisa G. Simms filed a lawsuit Aug. 26 in Madison County Circuit Court against Adam L. Cartwright.

In her complaint, Simms alleges she drove her Ford 150 truck on U.S. Highway 267 south in Godfrey on Nov. 25, 2011, at about 11:30 p.m. when Cartwright, who drove a 2004 Toyota Four-Runner at the intersection of Airport Road and U.S. 267, moved directly into Simms’s path. In turn, Simms struck the left side of Cartwright’s vehicle, according to the complaint.

In addition to her injuries, Simms suffered emotional distress, experienced pain and suffering and incurred medical costs, the suit states.

Simms blames Cartwright for causing the collision, saying he negligently failed to yield the right-of-way to Simms, drove across Simms’s path, failed to keep a proper lookout and failed to give any signals of his intent to enter the intersection.

In her complaint, Simms seeks a judgment of more than $50,000, plus costs.
