State Farm sued by policy holder seeking under-insured damages

A man has filed suit against his insurance agency, claiming it refuses to pay him for injuries he sustained in a collision.

Mark Goins claims he was injured in a vehicular collision on April 18, 2011. At the time of the accident, Goins had an insurance policy through defendant State Farm Mutual Automobile Insurance Company, which was supposed to pay for any losses associated with a collision with an underinsured driver, according to the complaint filed Aug. 16 in Madison County Circuit Court.

Although Goins has filed a claim with State Farm, however, the company refuses to pay him for his damages, the suit states.

In his complaint, Goins is seeking a judgment of more than $100,000, plus costs and other relief the court deems just.
