Fairmont gas station sued over customer's trip on step

A man who claims to have suffered disability after he fell on a step while trying to leave a gas station has filed suit in St. Clair County Circuit Court.

In his case filed Aug. 12, Robert O’Neal seeks damages from Shri Satya Sai Baba, Fairmont Phillips 66 and Phillips 66.

O’Neal alleges he had visited the Phillips 66 gas station located at 5404 Collinsville Road in Fairmont City on Sept. 7, 2011, and was attempting to leave when he fell on an “inherently dangerous” step at the front of the gas station.

Because of his fall, in addition to his disability, O’Neal lost his normal life and incurred medical costs, according to the complaint.

O’Neal blames the defendants for causing his fall, saying they negligently failed to ensure that the property was safe, failed to adequately warn of an immediate step down in front of the door, allowed a step to be positioned in a threshold of an exiting door and placed advertisements on the lower glass of the exiting door, which prevented customers from seeing the drop.

In his two-count complaint, O’Neal seeks a judgment of more than $100,000, plus costs.
