Granite City accident is subject of new Madison County suit

A woman has filed suit against the driver who she claims rear-ended her vehicle.

Marlene J. Gunderson claims she was driving in Granite City on Nov. 5, 2012, when defendant Lindsay M. Harlan rear-ended her vehicle.

Because of the collision, Gunderson suffered disability and disfigurement, endured great pain and mental anguish and lost earnings, according to the complaint filed Aug. 14 in Madison County Circuit Court. She also incurred medical costs and suffered from a seriously diminished earning capacity, the suit states.

Harlan negligently drove in such a manner so as to strike the back of Harlan’s vehicle, failed to keep a proper lookout, failed to properly apply her brakes, failed to reduce her speed to avoid a collision, followed Gunderson’s too closely and drove while distracted, the complaint says.

In her complaint, Harlan is seeking a judgment of more than $50,000, plus costs.

Gregory M. Tobin of Pratt and Tobin in East Alton will be representing her.

Madison County Circuit Court case number: 13-L-1373.
