Troy homeowners sued over 9-year-old's dog bite

The father of a nine-year-old girl has filed suit against the owners of a boxer who he claims attacked his daughter.

Roy Jarman claims his daughter, Samantha Jarman, was visiting defendants Scott and Brooke Osborn at their house at 1140 Martin in Troy on Feb. 6, 2012, when the Osborns’ boxer bit her below her left eye.

Because of the incident, Samantha Jarman experienced pain, suffering and mental anguish; lost her normal life; and endured disfigurement, according to the complaint filed Aug. 2 in Madison County Circuit Court. She also incurred medical costs, the suit states.

Roy Jarman blames the Osborns for the attack, saying they negligently failed to monitor their dog to become aware of its violent nature, harbored a dog that they knew to be aggressive, failed to adequately leash or restrain their dog, allowed the dog to roam the premises, failed to exercise reasonable care for their dog and failed to take adequate measures to prevent their dog from attacking others.

In his complaint, Roy Jarman is seeking a judgment of more than $100,000, plus costs and other relief the court deems just.
