A woman claims she suffered a fractured ankle after a truck driver failed to stay in his lane and struck her vehicle.
Erin Arman filed a lawsuit May 13 in Madison County Circuit Court against Terry Wayne Randall and Tyson Foods.
In her complaint, Arman alleges she drove east on Interstate 270 near mile post 4 on March 27, 2012, when Randall, who was driving in the same direction, struck her vehicle after he failed to remain within the confines of his lane.
Because of the collision, Arman sustained injuries including a torn right rotator cuff and a fractured ankle and left hand, and experienced pain, suffering and disability, according to the complaint. She also incurred medical costs of about $69,629.09, lost wages, experienced an impaired earning capacity and suffered a diminished capacity to enjoy life, the suit states.
Arman blames Randall for causing the collision, saying he negligently failed to keep a careful lookout, failed to yield the right-of-way, changed lanes when it was not safe to do so and failed to keep his vehicle within its lane.
Arman also names Tyson Foods as a defendant, saying Randall was driving a tractor trailer for the company when the incident occurred.
In her two-count complaint, Arman seeks a judgment of more than $100,000, plus costs and other relief the court deems just.
