Two people have filed suit against the driver who they claim rear-ended one of their vehicles, leading to a multi-car collision.
Darryl Meyenburg claims he was driving a 2007 Chevrolet Silverado east on Center Grove Road at its intersection with Troy Road in Edwardsville on April 13 when he stopped to wait for a red light. Co-plaintiff Dawn Meyenburg was driving a 2003 Dodge Durango in the same direction when she stopped behind Darryl Meyenburg, according to the complaint filed Jan. 29 in Madison County Circuit Court. Suddenly, Nicholas R. Kuhn, who was driving a 2008 Pontiac directly behind the Meyenburgs, struck the back of the Durango, pushing Dawn Meyenburg into Darryl Meyenburg’s Silverado, the suit states.
Because of the collision, Dawn Meyenburg suffered permanent injuries to her body, neck, back and left hand while Darryl Meyenburg sustained injuries to his body, low back, spine and nerves, the complaint says.
The Meyenburgs claim they also experienced pain and suffering, endured disability and disfigurement, incurred medical costs, lost wages, lost their enjoyment of life and incurred property damages.
They blame Kuhn for causing the collision, saying he negligently followed the vehicles in front of him too closely, failed to reduce his speed to avoid a collision, drove too fast, failed to keep a proper lookout and failed to brake to avoid a collision.
In their complaint, the Meyenburgs seek a judgment of more than $100,000, plus costs.
They will be represented by David A. Nester of Nester and Constance in Belleville.
