Ambulance district denies allegations in lawsuit

Alhambra Community Fire Protection District on Jan. 7 denied allegations in a lawsuit filed against it involving a Sept. 17 accident on I-55.

Edwardsville attorney Stephen Mudge on Jan. 7 announced his representation of Alhambra Community Fire District, doing business as Alhambra-Hamel Ambulance Service and Theodore Berg, Jr.

Plaintiff Rayburn Conway claimed he was riding in a Kenworth motor conventional cab driven southbound on I-55 by Daniel D. Eddinger.

Berg, a driver for Alhambra-Hamel Ambulance Service, turned right onto the exit ramp for the rest area, according to the Nov. 19 complaint.

“While operating the Kenworth Motor Conventional Cab, Daniel Eddinger was unable to stop, and the front end of his vehicle collided with the right side of the vehicle driven by Theodore W. Berg Jr.,” the suit states.

Conway blames Berg for causing the collision and for his injuries. Conway seeks more than $50,000.

The four occupants of the two vehicles were treated for serious injuries at Anderson Hospital in Maryville.

Bernard J. Ysursa of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville represents Conway.

Jonathan Ries, Rodney Sharp and Veronica Armouti of Sandberg Phoenix & von Gontard represent Anderson Hospital.

The case is assigned to Judge Ann Callis.

Madison County Circuit Court case number: 12-L-1894.
