Truck Centers sues American LaFrance claiming breach of contract

A trucking franchise alleges its parent company failed to repay more than $200,000 owed to it for work it had performed.

Truck Centers claims defendant American LaFrance had issued it a franchise on Feb. 19, 2007. Since then, Truck Centers submitted warranty claims to American LaFrance and delivered an American LaFrance vehicle to the Troy Illinois Fire Department, according to the complaint filed Aug. 7 in Madison County Circuit Court.

On Aug. 5, 2011, Truck Centers terminated its franchise agreement with American LaFrance, the suit states. At the time of the termination, American LaFrance owed Truck Centers $162,036.68 for unpaid warranty claims and $10,675.38 for the vehicle delivery, the complaint says.

Although Truck Centers has demanded American LaFrance repay the money, it has refused to do so, Truck Centers alleges.

In its complaint, Truck Centers alleges breach of contract against American LaFrance.

It seeks either treble damages of $486,109.74 or actual damages, plus interest, attorney's fees, costs and other relief the court deems just.
