Jimmy John's customer claims he tripped on CO2 container near soda machine

A man has filed suit against Jimmy John's, alleging he sustained injuries after tripping over a CO2 container.

Gary L. Williams claims he was visiting Jimmy John's Gourmet Sandwiches at 92 Northport Dr. in Alton on May 8, 2010, when he tripped on the CO2 container that an employee had left in front of the soda fountain.

Because of his fall, Williams sustained injuries to his low back, incurred medical costs and was prevented from attending to his usual duties, according to the complaint filed May 4 in Madison County Circuit Court.

A Jimmy John's employee negligently placed a CO2 container behind Williams as he was getting a soda, failed to remove the canister and failed to warn of the container, the suit states.

In his complaint, Williams is seeking a judgment of more than $50,000, plus costs and other relief the court deems just.
