St. Clair Square shopper claims injuries after being struck by garbage cart

A man claims he received back, leg and knee injuries after an employee for the St. Clair Square Mall ran a garbage cart into him.

Bryant Farmer alleges he was shopping at defendant St. Clair Square Mall on March 17 when defendant Barry Smith, a janitor who was employed by defendant ERMC, struck him with a garbage cart.

In addition to his injuries, Farmer became sick, sore, lame, disordered and disabled; incurred medical costs; suffered disability; experienced pain and suffering; and lost wages, according to the complaint filed May 1 in St. Clair County Circuit Court.

Farmer blames Smith for causing his injuries, saying the janitor negligently failed to keep a proper lookout, lost control of his garbage cart, failed to warn of garbage carts being used on the premises and failed to provide a safe place for people to use, among other negligent acts.

In his three-count complaint, Farmer is seeking a judgment of more than $150,000, plus costs.
