Passenger claims driver ran off the road in heavy fog

A St. Clair County woman has filed suit against the driver who she claims ran off the side of the road and into a pole while she was riding in his vehicle.

Taffy R. Cardonna-Stewart claims she was riding in a 2007 Chevrolet Monte Carlo defendant Jason M. Warfel drove south on Old Collinsville Road during heavy fog on Jan. 15, 2010, when the accident occurred.

"Defendant drove into a ditch causing the passenger side of the vehicle to hit a pole and thereby injuring the plaintiff," the suit filed Sept. 8 in St. Clair County Circuit Court states.

Because of the accident, Cardonna-Stewart became sick, sore, lame, disordered and disabled and experienced pain and suffering, according to the complaint. In addition, she incurred medical costs, the complaint says.

Cardonna-Stewart blames Warfel for causing the collision, saying he negligently failed to maintain control of his vehicle, failed to exercise reasonable awareness of his surroundings and failed to exercise reasonable care by driving in heavy fog.

In her complaint, Cardonna-Stewart is seeking a judgment of more than $50,000, plus costs.

She will be represented by Stephen R. Clark of Courtney, Clark and Mejias in Belleville.
