An East St. Louis corporation claims a construction company defectively designed its roof, causing roofing materials to fall from the top of the structure.
Metro East Industries filed a lawsuit May 24 in St. Clair County Circuit Court against Holden Construction Services and A-1 Top Quality Construction.
Metro East alleges Holden sent it a bid to perform certain roof replacement and repair work at Metro's railcar repair facility in Alorton on March 10, 2008.
Metro accepted the bid, so Holden retained A-1 to perform the work and provide the materials, according to the complaint.
"Just over one year after A-1 purported to perform the work and provide the materials referenced in the Bid, MEI began noticing substantial failures in the work and materials provided," the suit states. "Specifically, among other failures, roofing materials began to detach and slide off of the Facility's roof. This has caused significant damage to MEI's Facility, including damage to portions of the roof and other property at MEI's facility."
To fix the problem, Metro will have to pay $117,000, the complaint says.
Metro alleges breach of contract and products liability against the defendants.
In its four-count suit, Metro seeks no less than $468,000, plus other relief the court deems just.
