Heads, necks and backs injured in collision, suit says

Two people claim their heads, necks and backs were injured after a woman rear-ended the vehicle in which they were riding.

Nancy M. and Gary W. Thomason filed a lawsuit Aug. 12 in St. Clair County Circuit Court against Angela D. Moyer.

The Thomasons claim Nancy Thomason was driving north on North Illinois at its intersection with Ashland in Fairview Heights on June 25. Riding with her was Gary W. Thomason, according to the complaint.

Suddenly, Moyer struck the rear of their vehicle, the suit states.

In addition to her head, neck and back injuries, Nancy Thomason received injuries to her arms.

Both Nancy and Gary Thomason were made sick, sore, lame, disordered and disabled, incurred medical costs, were disabled, experienced pain and suffering and lost money from a loss of wages.

They blame Moyer for failing to keep a proper lookout, for driving so as to strike the rear of their vehicle, for failing to properly apply her brakes, for driving too fast and for following the Thomasons too closely.

In the two-count suit, the Thomasons are seeking a judgment of more than $100,000, plus costs.

Thomas C. Rich and Jennifer L. Barbieri of Fairview Heights will be representing them.

St. Clair County Circuit Court case number: 09-L-420.
