Godfrey woman names construction company in auto accident suit

A Godfrey woman has filed suit against a construction company and one of its employees, alleging she sustained permanent injuries after the employee rear-ended her.

Linda Schafer says she was driving her 1998 Ford Taurus south on U.S. 67 near its intersection with Stagecoach Road on May 31, 2007, at about 3:35 p.m. when the collision occurred.

According to the complaint filed May 29 in Madison County Circuit Court, Richard L. Killon was also driving a 2000 Ford F250 Series truck south on U.S. 67 when he collided with the back of Schafer's vehicle.

"As Linda Schafer attempted to make a lawful turn from U.S. 67 onto Stagecoach Road, Defendant, Richard L. Killon, negligently breached the aforesaid duty he owed to the Plaintiff, Linda Schafer, violently colliding his 2000 Ford F250 Series truck into the rear of Linda Schafer's 1998 Ford Taurus," the suit states.

At the time of the collision, Killon was working for Killon Construction Co., the complaint says.

As a result of the collision, Schafer says she suffered disability, disfigurement, physical pain, mental anguish and impairment of enjoying her everyday activities. She also incurred medical costs, was hindered from pursuing her normal course of employment and lost wages, according to the complaint.

In addition, Schafer lost the use of her car and incurred towing and
repair costs, the complaint says.

Killon was negligent by driving too fast, by exceeding the maximum speed limit, by failing to exercise due care, by failing to drive with due regard for the safety of others, by failing to keep the vehicle under control, by failing to keep a lookout and by failing to reduce his speed, the suit states.

In the three-count complaint, Schafer is seeking a judgment of more than $105,000, plus costs.
