A personal injury trial against Olin Community Credit Union in Godfrey has been postponed.
Plaintiff and defense attorneys will meet to set a new trial date June 24.
The 2007 suit stems from a 2005 fall in the credit union's parking lot.
Carole Massalone had been conducting business at Olin and was leaving when she fell. Her suit alleges that the credit union was negligent in failing to warn visitors of a change in elevations between the sidewalk and parking lot caused by an unmarked handicapped ramp. The suit further contends that the credit union did nothing to mark the ramp and that it had a duty to do so.
According to the suit, Massalone hurt her knees and left elbow. Her injuries caused her pain, suffering and caused her to incur medical expenses. She also charges she will suffer in the future and lost money.
Massalone is suing for damages in excess of $50,000 and for costs.
Olin denied Massalone's allegations in its answer.
The case was removed from the court docket May 26.
Madison County Circuit Judge Dennis Ruth is presiding.
Massalone is represented by Samuel Mormino. Olin is represented by James Craney.
The case is Madison case number 07-L-070.
Trial date to be set later this month in Godfrey parking lot fall
