Man claims garbage truck rear-ended him

Jerome Tucker claims his neck, upper back and shoulders were injured after a garbage truck rear-ended him.

Tucker was attempting to exit the Bethalto Walgreen's on Dec. 28, 2007, when a truck driven by Gregory Tindall for Allied Waste Transportation, struck him, according to the suit he filed April 27 in Madison County Circuit Court.

In addition to his severe and permanently disabling and disfiguring injuries, Tucker sustained great pain and mental anguish, lost large sums of money because of his inability to enjoy his normal activities and incurred medical costs, the suit states.

Tindall failed to reduce his speed, proceeded to pull out when it was not safe, drove too fast and failed to keep a proper lookout, the complaint says.

Allied Waste was liable because Tindall was its employee.

In the two-count suit, Tucker is seeking a judgment in excess of $100,000, plus costs.

Gregory L. Shevlin of Cook, Ysursa, Bartholomew, Brauer and Shevlin in Belleville will be representing him.
