CitiFinancial sues over defaulted loan

CitiFinancial Services has filed a breach of contract suit against Matthew E. Duke of Alton, alleging he defaulted on a note and security agreement.

Represented by J. Gregory Scott of Decatur, CitiFinancial alleges Duke received a $9,199.92 loan on June 7, 2007, with an annual interest rate of 26.18 percent.

According to court documents filed Sept. 15 in Madison County Circuit Court, Duke was obligated to make 60 monthly payments of $276.43 for a total of $16,585.80, but defaulted on the note when he failed to make the required monthly payments.

CitiFinancial claims as of Sept. 11, Duke still owes $9,561.99 in principal plus interest and seeks a judgment in that amount plus interest accruing under the agreement plus $500 in attorneys' fees and costs of the suit.

The case is awaiting mandatory arbitration.
