Tillery to share $1.6 million Allstate class settlement

Stephen Tillery of St. Louis and two other attorneys will divide more than a million and a half dollars in fees from a Madison County class action suit they settled with Allstate Insurance.

Circuit Judge Nicholas Byron signed an order May 24, awarding the attorneys 29 percent of a settlement worth $5,541,782.

That works out to $1,607,116.78.

From that amount the attorneys will give $5,000 each to eight plaintiffs.

Tillery associate Lisa Kernan and attorney Jay Angoff of Jefferson City, Mo., will receive shares.

The plaintiffs claimed Allstate charged more than it should have on policies for drivers who had previously carried policies of high risk insurers.

Policyholders who paid "tier adjustments" from 1997 to 2005 will get back three fourths of those adjustments, minus the attorney's fees.

Policyholders who did not receive discounts from 1991 to 2005 will receive half of the denied discounts, minus the attorney's fees.

Policyholders who paid surcharges from 1991 to 2005 will get back 17.5 per cent of the surcharges, minus the attorney's fees.

About 47,000 persons received notice of the settlement. None objected, but 252 chose to opt out and preserve their claims.
