A Collinsville Shop ‘N Save customer claims she sustained low back injuries after slipping and falling on red Poweraid in a grocery store aisle, according to a suit filed Sept. 21 in St. Clair County Circuit Court.
Erica Barnes claims the store, located at 9529 Collinsville Rd., and managers Ricardo Fuentes and Greg Peludat, were negligent for “permitting” the soft drink to fall and remain on the floor.
“The red Poweraid was allowed to remain there until the happening of the occurrence,” the complaint states.
Barnes, seeking in excess of $45,000 in damages, is represented by Benjamin F. Goldenhersh of Goldenhersh & Goldenhersh in Belleville.
The accident happened approximately a month ago, on Aug. 26, at 5 p.m.
“Barnes then and there sustained severe, permanent and progressive injuries, both externally and internally, and was thereby greatly injured,” the complaint states.
“By reason of her injuries, she has had and with reasonable certainty will continue to have disability or loss of a normal life, pain and suffering, medical expenses and lost wages or earnings.”
