Kentucky clients file against CSX in St. Clair County

Charles L. Armbruster of the Lakin Law Firm in Wood River filed two personal injury lawsuits against CSX Transportation on behalf of Kentucky clients Norman L. Capps and Ronnie Frederick in St. Clair County Circuit Court Aug. 12.

The nearly identical suits claim the men, both track repairmen, were required to work in conditions that exposed them to excessive and repetitive trauma to their lower back, middle back and neck.

"Despite possessing knowledge of the harm being inflicted upon the plaintiffs and other employees, the defendant failed to take any steps to reduce or eliminate the excessive and repetitive trauma that was being inflicted upon plaintiffs," the suit states.

CSX Tranpsortation, a Virginia corporation, does substantial business in St. Clair County, according to the complaint.

"A substantial part of the events forming the basis of this (these) lawsuit(s) occurred in St. Clair County," it states.

Each suit seeks in excess of $50,000 for damages that include:

  • Past and future lost wages and benefits;

  • Permanent impairment of ability to earn a living;

  • Past and future medical expenses;

  • Past and future physical pain and mental anguish;

  • Permanent physical disability; and

  • Inability to carry out and enjoy the usual and normal activities of life.
