Fire loss leads to suit against Farmers Insurance

Seeking damages in excess of $320,000, Smithton residents Loretta and Gary Bearden filed suit against Farmers Insurance Co. in St. Clair County Circuit Court June 17 for denying their fire claim.

The Beardens claim that on July 9, 2004, their detached garage caught fire and exploded, destroying all of the contents.

According to the complaint, the Beardens' residential policy included protection against any losses at 700 South Main, in Smithton.

The Beardens claim that after numerous and reasonable requests to pay for the damage, Farmers has refused to pay and also has not offered any reasonable excuse.

They claim to have been deprived of payments for their personal property due to Farmers vexatious refusal to pay.
